NCAA attorney Rakesh Kilaru is fielding Wilken's questions about roster limits and athletes being cut. He defends it by noting that athletes can be cut now, and that while roster sizes may decrease, more athletes will be able to receive scholarships under the settlement.

Wilken is prodding Kessler about whether the settlement means future athletes (like a current 10 year old playing kickball) are unknowingly opting out of future House claims without knowing it. This came up in the preliminary approval hearing as well.

Attorney Jeffrey Kessler, who brought the House case, claims the $2.75 billion settlement will be one of the largest in the history of antitrust law.

Wilken: There is a complaint about the College Football Playoff not being included in the settlement. "I hope we don't have to spend much time on that."

Judge Wilken indicates she still has concerns about the portion of the settlement limiting third-party NIL payments to athletes, in regards to antitrust law. (The proposed Deloitte clearinghouse.)

Most importantly, Judge Wilken says she will not rule from the bench today on the settlement approval.

Judge Wilken says out of 390,000 class members, there were 343 opt-outs, 73 objectors, and 73,000 people put in claims (for damages). "That’s quite a surprising and large number of responses in a class action case," she says.
