NCAA attorney Rakesh Kilaru is fielding Wilken's questions about roster limits and athletes being cut. He defends it by noting that athletes can be cut now, and that while roster sizes may decrease, more athletes will be able to receive scholarships under the settlement.

Wilken is prodding Kessler about whether the settlement means future athletes (like a current 10 year old playing kickball) are unknowingly opting out of future House claims without knowing it. This came up in the preliminary approval hearing as well.

Judge Wilken says out of 390,000 class members, there were 343 opt-outs, 73 objectors, and 73,000 people put in claims (for damages). "That’s quite a surprising and large number of responses in a class action case," she says.
